Mediation is an informal, non-binding process in which an impartial third-party assists couples to resolve all or part of the lawsuit. Mediation has been used for decades as an effective and efficient way to resolve cases without the need for an expensive trial.

Families may agree to mediate before filing for divorce. This is called pre-suit mediation. In pre-suit mediation, couples can resolve all issues regarding their divorce, including child support and creating a parenting plan. Once all issues are agreed, it is reduced to writing and provided to the couple to file with the Court. Usually all that is needed at that point to finalize the divorce is a final hearing before the Judge.

Couples may attend pre-suit mediation either with their own attorneys or pro se (unrepresented by legal counsel). Although a mediator may also be an attorney, a mediator does not represent either party and is neutral in helping the parties reach an agreement.

Utilizing a pre-suit mediation with a Florida Supreme Court Certified Family Mediator means that you will not have to purchase the forms from the county clerk and you will be directed to fill out all of the necessary documents that is required in your case.

For couples involved in an on-going case, it is also beneficial to seek the help of a Florida Supreme Court Certified Mediator. Often times, there is a greater availability for long mediations (if the case requires) or scheduling mediations over multiple days to ensure a full settlement can be reached.
